Court fees in civil matters
The court fee is an allowance for the courts , a payment so the court can take action, therefore those involved in bringing a civil must reconcile with the fact that court costs must be paid to the court. The principles and procedures for the collection of court costs in civil matters, the return of court costs, the amount of court costs in civil cases, the principles regarding exemptions from court costs and debt, and the financing of court cost into an installment plan and deferring the payment due date are governed by the Act of Court Regulations regarding court costs in civil matters, established July 28, 2005. Under the said act the party responsible for the court costs , is the party bringing the complaint , or causing the cost to occur. The payment of the court costs must be made upon bringing a complaint to court, or filing a written complaint with the court. The act calls for a fixed fee , relative or basic. The fixed fee is paid in cases not regarding property rights or estates, and in some cases, matters involving that of property rights , being the same fee, regardless of the amount or worth of the item(s) in dispute. The fixed payment cannot be less than 30 zloty and cannot be more than 5000 zloty. The act specifies the amount of fees to be paid depending on the type of case filing, for example; divorce , separations, protection of personal rights or protection of copyrights , call for the court to charge a quota of 600 zloty. Relative fees are charged in cases of property rights or estate rights . The payments amount to 5%of the amount in dispute or amount subject to challenge, but no less than 30 zloty, and no more than 100,000 zloty. Basic fees are charged in cases where the law does not call for fixed fees, relative nor temporary. The basic fee for such instances is 30 zloty. The party which loses the case is obligated to pay the winning party , at their request, the costs incurred for investigation, legal defense, and court.
Court costs in administrative matters
Court costs are an allowance made to the court, a payment made so that the court can take action, therefore the party bringing a matter to the administrative courts must reconcile with the fact that they are responsible for the necessary court payments. The principles and procedures for the collection of court costs in administrative court cases , the return of court costs, the amount of costs in administrative matters, the regulations exempting individuals from costs, and the rules for financing court costs into payments and deferring due dates for court costs , are governed by The Act of Court Regulations effective August 30, 2002. The law regarding proceedings before the administrative courts also the Council of Ministers was enacted December 16, 2003, and it details the regulations and rules for entering a matter before the administrative courts. In accordance with this act, the party responsible for payment of court costs, is the party bringing the complaint before the court, or the party causing the cost to be incurred. The court costs must be paid at the time the letter of intent to pay is filed and the letter of complaint is filed with the court. The court will not take any action if a letter of intent filed along with payment has not been made to the court. The amount of the payment in the letter of intent depends on amount or monetary value of monies or items in question. - Up to 10,000 zloty- 4% the value of contested amount, but no less than 100 zloty -Over 10,000 to 50,000 zloty- 2% the value of contested amount , but no less than 1, 500 zloty -Over 50,000 to 100,000 zloty- 1% the value of the contested amount, but no less than 2,000 zloty and no more than 100,000 zloty. Regulations determine the amount of the permanent payment to be paid depending on the type of case filed. Complaints concerning concessions, permits or authorizations to conduct businesses in the areas of: construction and operation of toll motorways and expressways, energy, aviation (air transport), railways, maritime transport, radio and television, direct and reinsurance, pension funds or investment funds, have an entry fee of 10,000 zloty. In the case that a complaint is upheld by the courts in the first instance, the individual or entity in violation of or causing said complaint is responsible for the cost of investigations and legal actions take to come to said decision.
